Navigating the immigration process can be challenging, especially when facing unexpected difficulties. Today, we share an inspiring story of resilience and determination, highlighting our expertise in assisting clients through complex immigration situations.
Case Overview
Our client, originally from India, arrived in New Zealand on a student visa. Due to unforeseen circumstances, he was unable to maintain his lawful status and became an overstayer for over 10 years. Despite these hardships, he built a life in New Zealand, contributing to the community and forming meaningful relationships. He eventually met his partner, a New Zealand resident visa holder, who was committed to supporting him in regularizing his status through a Section 61 application.
The Challenge
Our client faced the daunting task of addressing his unlawful status, which had persisted for over a decade. The complexity of his situation required a well-prepared and compelling case to be presented to the immigration authorities.
Our Approach
We conducted a comprehensive assessment of the client’s situation, understanding the full scope of his overstay and his relationship with his partner. We gathered extensive evidence of his relationship with his New Zealand resident partner and his positive contributions to the community. A compelling submission was prepared, addressing the humanitarian and compassionate grounds of his application. We ensured all documentation was meticulously organized and submitted, presenting a strong, well-rounded case to the immigration authorities.
The Outcome
Thanks to the thorough preparation and strategic approach, the Section 61 application was successful. Our client was granted a visa, allowing him to continue his life in New Zealand with his partner, free from the fear of deportation.
Next Steps: Partnership-Based Work Visa
Following the successful section 61 approval, we are now preparing to submit a Partnership-based work visa application for the client. This will enable them to work in New Zealand and continue building their life here with their partner.
Note: The client and Simon never once met in person and conducted all communications through our advanced IT system. It was due to the restrictions on travelling and meetings because of Covid-19. However, when the restrictions got lifted, our firm decided to continue the no face to face meeting policy after we found out it was more practical and efficient.
