A couple of years ago, a Brazilian woman married to a New Zealand resident approached us after her partnership-based resident visa application was at risk of being declined due to character concerns. Initially handled by another licensed immigration adviser, the case became too complex, prompting the adviser to recommend seeking more experienced assistance. By the time we were engaged, the application was already under final assessment, and the visa was ultimately declined.
The couple found our services through a Google search and booked a consultation with Simon, our CEO. During this session, Simon carefully reviewed the case and immediately proposed appealing the declined decision to the Immigration and Protection Tribunal (IPT). Despite setbacks, including the visa's expiration and the applicant becoming unlawful during the waiting period, Simon acted swiftly. He guided the client in filing a Section 61 request, managed multiple PPI responses, and prepared a strong character waiver submission supported by compelling documentation. After successfully appealing to the IPT, the case was flagged for reassessment by Immigration New Zealand (INZ). Despite the challenges, including contracting COVID during the process, the client's partnership-based resident visa was eventually approved. The entire journey, spanning two and a half years, highlights the importance of expertise, attention to detail, and persistence in navigating complex immigration cases. This case exemplifies success in overcoming declined partnership visa decisions, character waivers, and unlawful status, leading to a favourable outcome for our client.
