Successful Unlawful/Section 61 case - 26

A couple organised a paid consultation with Simon in August 2020. She was unlawful for more than ten years and had a deportation order placed on her. 

They were distraught that she would be deported. Simon explained to them what he would resolve her matter step by step. He advised them that it is not easy but doable if they follow his instruction. He explained that doing it properly would take more than a year. 

As soon as Simon engaged with her, he communicated to her compliance officer to withhold the deportation order while he was preparing her Section 61 application. She had to report to the compliance officer every Monday. Simon also informed the compliance officer of her section 61 application process so the officer would not impose the order.

Once her section 61 application was successful, she was given 6 months visitor visa. Then Simon engaged with her to prepare for her Partnership based work visa application with character waiver. There were multiple PPIs, but he successfully defended her with his character waiver application. 

As soon as her partnership based work visa was approved, she secured a full-time job for the first time since she was unlawful, more than ten years. While she was living a new life, Simon and she prepared her resident visa application. 

Once again, her case officer challenged us, but she and Simon worked together to prepare her character waiver application and responded to multiple PPI letters. 

Finally, last week her resident visa was approved. It was a dramatic outcome considering she was unlawful for more than ten years and had a deportation order in 2020, and now she is a lawful resident in NZ with her full-time job and upcoming promotion. 

For the last year and seven months, she and Simon worked as a team to tackle her challenges to arrive at this outcome.
